I know this may be inconceivable to the liberal and particularly north of the border neo socialist perspective, but I rather suspect the SCOTUS ruling will have little practical impact on Trump's eventual tariff agenda. That said, much of the legal community will no doubt see this as the latest black mold or asbestos opportunity to exploit class action hopes to enrich themselves. Those of you in the Canadian legal profession (maybe not @Pheroze) really ought to urge your firms to get to the head of the line.

I don’t think the law in Canada would support a finding of a duty of care to any one person or corporation here in this situation. That hasn’t been my experience anyways. I don’t understand the basis for a claim for a failed policy. I could see judicial reviews to negate policy that was unauthorized. But I don’t think damages would be awarded. Just peasantly hourly rate work, sheesh !
 
I hate going to the doctor, especially on any kind of “subscription plan”. Sad to see some go as a social event. I’ve gone years without seeing a doctor, going only after an injury requiring attention. After an extended absence and continual prompting by my PCP, I relented and went in for a check up a couple months ago. Of course they require you fill out a patient update form before being called in to see the doc, This time they had installed a couple of e-pads at the reception desk to use instead of the normal paper form.

I don’t know who wrote the questions but it was creepy and weird! Every other question was a prompt encouraging an answer indicating you have some form of mental problem or were contemplating suicide! They also used the old questionnaire trick of repeating same questions embedded throughout the questionnaire in obvious effort to catch you contradicting yourself. I have no idea what agenda this medical group is in on but something is afoot and I’m afraid there is some gov grant money dangling in the background enticing this behavior. It was a creepy experience! I wouldn’t doubt a company lawyer and/or gov rep used some form of AI to construct the questionnaire. I’m 76, an independent thinker, physically and mentally healthy and smart enough to recognize something wasn’t/isn’t right, at least in this example of our medical-government-industrial complex. BOLO ;)

You know, there may be something to that. I hadn’t thought of that angle but given the hard left blue that Colorado has turned and being an early, red flag proponent, there could be a connection. Dunno? Maybe there is some random, broad brush fishing going on

Gulf Stream had been waiting 7.5 years for Canada to get off its ass and certify its aircraft..

Canada claimed it needed to do additional testing to ensure the aircraft could operate in the cold safely..

Funny.. the FAA already certified it.. the European Union already certified it (there are some pretty damn cold countries in the EU)…Russia and Mongolia, often cited as the two coldest countries on earth already certified it…

But Canada sat for 7.5 years… and planned to continue to sit.. until threatened by Trump..

Clearly trying to protect Bombardier… clearly just another means of impacting trade (other than a tariff)… and clearly a shitty and disingenuous move on the part of the Canadian government..

The US is certainly not without sin…

But all the BS whining, crying, and screaming about the US now playing hardball.. while refusing to acknowledge that Canada, Europe, and others have been playing hardball all along… is kind of ridiculous..

The rest of the world simply doesn’t like the tables getting turned on them..

There is some questionable debate about refunding companies that paid tariffs over the SCOTUS decision has basically deemed Trump's ability to set tariffs invalid.
Tariff costs are basically passed on to the consumer, or end user of any given product.
Are we going to get refunded, or are the companies that dealt with higher tariffs going to unfairly profit from any refunds, since that cost increase has already been passed on?

Sounds like a situation that may also end up on the SCOTUS docket

IEEPA was quick and easy. Trump signs a paper and tariff is in place. Most of the other laws take findings by Commerce Department and can take weeks or months to add tariffs.

It looks like after oral arguments on IEEPA in November that findings were started and the administration was preparing to move many of the tariffs under other laws pending the ruling.

IEEPA is an interesting law that doesn’t mention tariffs. Trump can stop all imports from any country under IEEPA. He can require special licenses (most licenses come with a fee). The SCOTUS ruling says he can’t charge a fee. Kavanaughs dissent basically said it is stupid for Congress to allow the President to stop all imports from a country but not allow the President to charge a fee. The majority thought otherwise.

This is my layman’s synopsis after skimming the decisions and dissents. Scholars and attorneys on AH may have different opinions.

Kavanaughs dissent pretty much laid out the path and laws the Trump administration can use keep Tarriffs in place. This ruling changes the method but not the outcome.
 
I find it interesting that Robert’s will reinvent words to save Obama Care then restrict meanings to disrupt tariffs. Robert’s knows, as Kavanaugh lines out, the tariff case doesn’t really hurt Trump.

Is Robert’s throwing a bone to the left prior to the decision on Louisiana vs Callais so he can represent that the Court is fair to both sides. :unsure:

If the L v C opinion comes out the way the pundits seem to think, the left’s heads will explode and they will be calling for the Court to be packed.
 
Kavanaugh always seemed to be a very middle of the road Judge. When appointed it looked to many he would be the fulcrum of the Court. Left of Thomas, Alito, Roberts and Gorsuch.

His rulings have seemed to be more originalist/constitutionalist since his appointment. I have wondered if his treatment surrounding the Senate confirmation hardened or gave him an I no longer care what people say attitude.

This is far far from being a done deal.
There are several more Exececutive Branch levers left to be pulled...and you can bet he'll jerk every one of them if necessary.

Trump created his own problem on tariffs. It was hard to see any other outcome with his ridiculous moves. Tariffs are just one tool in international trade. I predict that a more considered approach by sector and country will be adopted to achieve the same desired ends. Almost certainly with better results. I’d suggest the man learn some patience and decorum, but I’d be wasting my time.
