Federal revenues are distributed based upon congressional authorizations and appropriations. Those allocations and appropriations are generally of an annual basis. Should the budget time out without either new budgets or a continuing resolution allowing expenditures at current budget levels, the money sits in a big digital pile. In other words, no one has the authority to use those as of yet unappropriated funds for any purpose requiring congressional action. The current "clean" continuing resolution would continue last year's appropriations at the current spending rate until the passage of either yet another CR or a budget. Using contingency funds is legally complex and the administration has asked the two judges demanding their use, how to proceed, though they are using those funds to pay about half the requirement.
