GunBroker rip off

I was wondering if anyone had experienced this before. I purchased a suppressor off gunbroker. I won the auction back in September. I immediately tried to pay and the seller did not reply to my first email. I sent a second email a week later and he replied telling me to "chill out" and stated that he had a problem with his FFL license. He said it would take about 6 weeks before we could complete the purchase. Two months goes by and I sent him another email and he said that he had just gotten his FFL license straightened out and I was able to pay for the suppressor on December 5th. The status still didn't show as shipped so I contacted him via email again today 12/12 and he told me he was canceling the order because I was annoying him. I told him I didn't want to cancel the order (I won it for a good price). He marked it as a returned item and issued a refund (that I've not gotten yet) but the item was never shipped. Can he legally do that? I thought once an item is paid for it's a legally binding contract. I contacted Gunbroker customer service, but Lord only knows how long it will take them to reply.

Sounds like he wasn’t happy with the strike price. Leave him negative feedback. That’s about all you can do.

You have done the two things you can do-specific negative Feedback and report him to GB.
 
@stk, Just curious, do you have a Trust or whatever where you can legally get a suppressor that quick? Most people I talk to say it takes a year or so to purchase a suppressor.

It was being shipped to my FFL in my local town. There is a two week wait time from one FFL to another. I wouldn't be able to take possession of it for a few more months.

There is no "wait time". There is a process, docs to be filed and the feds are involved so it often takes a week or two for the dealer to dealer transfer. You will be able to take possession after you pay the $200 fee, complete the E-File process and get an approval from the ATF. The wait time is impossible to predict. Most of the approvals we are getting back right now took 5-6 months to process. But we get the random approval back that only takes 3-4 months. And we have a few still pending that were filed over a year ago.

All that being said we will not accept transfers from other dealers on silencers that have already been purchased. Lots of paperwork, months of storage for a transfer fee...no thanks.

I promise dealers are frustrated because its not possible to give customers a good time line. When we switched from paper to the E-file system ATF promised all of the long wait time issues would be solved and we could expect approvals in 90 days max. It started out great, we got our first E-File approval in 72 days, but within a couple of months the approvals pretty much stopped, and it got to the point where 8-9 months was the norm, pretty much at same as with the paper filing. But as I said before it has improved in recent months with a lot of approvals coming back in 5-6 months.

trperk1, I bought the Kimber Caprivi 375 back in an earlier post. You attached a target with an impressive three rounds touching 100 yards.
